En el artículo anterior, recordábamos que  los requisitos en el ámbito de la Prevención de Riesgos laborales, vinculado al área de Coordinación de Actividades Empresariales, a cumplir por empresas o trabajadores autónomos comunitarios son idénticos a los exigidos para empresas nacionales. En consecuencia, en lo referente a la gestión documental (deber de control inicial), la documentación a solicitar previa al inicio de los trabajos, es la misma a excepción de la relativa a la Afiliación del trabajador a la Seguridad Social. Recomendamos por ello que el resto de documentación a solicitar se encontrara traducida al inglés o al idioma preferente de las empresas extranjeras con quienes se externalicen servicios. Les ofrecemos un listado de los documentos que suelen solicitarse traducidos al inglés:

 

Documentation that should be required from the company before execution of the work :

-Documentation of the Company
1. Photocopy of the company’s vat number and deed of incorporation, or private vat number
2. Civil and third party liability insurance (in accordance with the general conditions of contract).
3. Workers compensation insurance
4. Risk Assessment Report order Safe Working Procedure of the works or service under contract, including general and specific hazards, hazard analysis, protective measures (both collective and individual), preventive planning for the tasks to be carried out and work procedures.
5. To ensure contract workers comply with safety protocols, contractors have to designate someone to be responsible for safety

– Worker’s documentation
1. Certificate of Personal Protective Equipment, where the tasks to be performed so require.
2. Health Surveillance Report for the work to be carried out.
3. Certificate assuring health and safety of workers through information and training about existing general and specific hazards in the work centre

In case of subcontracting, document wherein the subcontractor undertakes to comply with the obligations arising from the contract as if it where the main contractor

Documents that must be submitted during the execution of the Contract:

1. Immediate notification in the event of accidents, incidents and risk
2. List of names of the contractor’s workers who are to provide services in the performance of the work under contract, specifying their professional category, national identity document number (passport) and type of employment contract and duration thereof, and details of workers subject to special hazards
